Terms and Conditions – Sure Skate Photo Competition.


This Promotion is open to all UK, Isle of Man and Channel Island residents, aged 18 years or over. Proof of age may be required. Employees (or family members of employees) of any Cable & Wireless Group and/or Nokia Siemens Group company, companies associated with the Promotion and all affiliates of such companies (collectively “the Companies”) may not enter any prize draw or competition.

By participating in this competition and in consideration for the opportunity to be awarded a prize, you agree to be bound by the following terms and conditions. You should read these terms and conditions carefully. If you do not agree to be bound by these terms and conditions you may not take part in this competition. Entries will be accepted only if they are in accordance with these terms and conditions. No correspondence will be entered into. Any breach of these terms and conditions by an entrant will render their entry void. These terms and conditions shall be interpreted in accordance with, and shall be governed by, English law.
To take part in the Sure Skate Photo Competition you must submit your photo, along with your name, email address and the name of your photo, by 5.00pm on Monday 4th January 2010 by one of:
4. Picture messages (MMS) to 238238 will be free to Sure Customers (except when roaming outside the Channel Islands and Isle of Man[p1] ). Customers of other networks will be charged at their network’s standard picture messaging rate.
5. Entry by email will be free to all participants.
6. Sure does not accept responsibility for network, computer hardware or software failures of any kind, which may restrict or delay the sending or receipt of your photo. Entries must not be sent in through agents or third parties. Proof of posting is not proof of receipt. No responsibility will be accepted for entries that are delayed. Late, damaged, defaced or illegible entries will be disqualified. Sure is unable to accept responsibility for any entries that are damaged during electronic transit or which we just don’t receive.
7. By entering the competition you are giving Sure permission to publish your photograph by uploading to www.flickr.com/sureskate for the duration of the competition.
8. The winner’s photograph may also be published by Sure for up to 6 months after the competition closes.
Only one photograph per entry.
Sure reserve the right to refuse entry to the competition if the photo is deemed unsuitable. You agree that you will not submit any material to the competition that infringes the rights of any party or contains any images or content that is in any way unlawful, harmful, threatening, defamatory, obscene, harassing or ethically or otherwise objectionable and facilitates or promotes illegal activity, depicts pornographic or sexually explicit images or promotes violence or discrimination. You must be the sole author and owner of the copyright for all images you send us. (If you’re not sure about copyright, here’s a tip: you always automatically own the copyright of the pictures you take, unless you’ve signed away that right in a previous contract).
You will retain the copyright for all the images you submit to us. By entering your images into the competition, you grant Sure a “non-exclusive, royalty-free, irrevocable licence” to use and reproduce the images for any purpose in connection with the competition and for use on a non-commercial basis by Sure. Might sound complex, but here’s the basic translation: “non-exclusive” means you can still use the photos yourself or license them elsewhere, if you wish; “royalty-free” means we won’t pay you for using your pictures in this context (your talent gets some free publicity instead); “irrevocable” just means you’re giving us permission to use the photographs for as long as we need them. If we would like to reproduce or use your images for any other purpose, we’d negotiate this with you first.
Entrants must be 18 years or over.
Closing date for entries is 5.00pm on Monday 4th January 2010.
There will be a one first prize only. The winner will be picked by a representative from Nokia Siemens Networks and notified by email by 15th January 2010. The judge’s decision has to be final – we can’t enter into any correspondence
Prize details: a Nokia 5630 Xpress music handset. There is no cash alternative to the prize and unless agreed otherwise in writing the prize is non-refundable and non transferable.
Sure reserves the right to substitute the prize for a prize of equivalent or greater monetary value if this is necessary for reasons beyond its control.
The terms and conditions of any third party supplier will apply to the prize where applicable.
Sure’s decision is final and legally binding on all entrants. No correspondence will be entered into. Entries that do not comply in full with these entry rules and conditions will be disqualified.
The name, place of residence and photograph of the winner may be used by Sure and its associated companies for post-event publicity purposes.
Sure will keep details of any entry that you make. By entering the Sure Skate Competition you allow us to see and share this information with other companies including for sales, marketing and market research purposes and to send you information by mail about our products/services. By entering the competition, the winner consents to take part in any publicity accompanying or resulting from this promotion, and for their name to be used for publicity purposes by Sure.
Except in the case of death or personal injury arising from its negligence or in respect of fraud and so far as is permitted by law, Sure and its associated companies and agents exclude responsibility and all liabilities arising from any postponement, cancellation, delay or changes to the prize details beyond Sure's control and for any act or default of any third party supplier.
You agree to indemnify, defend and hold harmless Sure, their officers, directors, employees, agents, licensors, suppliers or other representatives against any and all claims, demands, losses, expenses, damages and costs, including legal costs, however arising and resulting from any violation or breach by you of these terms and conditions or any claims made by or liabilities to any third party resulting from any material submitted by you in the context of the competition or any activities conducted by you in connection with the competition, including but not limited to infringing any party’s rights, or otherwise arising out of your breach of these terms and conditions.
